Two buyers can receive an identical dataset and derive very different economic value from it. One needs internal reporting; another wants to create derived features; a third hopes to redistribute results to paying customers. A defensible pricing model should treat permitted use as a product dimension rather than a footnote after the invoice.

A dataset is not the same as permission to exploit it

The W3C ODRL Information Model defines permissions, prohibitions, duties, assets and parties for expressing usage conditions. That structure gives data product managers a vocabulary for describing what an enterprise buyer actually acquires. For example, internal analysis, model training, sharing derived aggregates and redistributing raw records are economically different rights. A contract that says “enterprise license” without identifying these actions forces customers to guess and creates costly disputes later. Build the rights catalog before assigning tiers. Each commercial offer should reference a dataset version, covered jurisdictions, permitted purpose, term and named recipient class. Distinguish technical ability to download data from contractual permission to reuse it. A shared link or API key is access control, not a complete license. The price is only meaningful after the permitted value-generating activity has been specified.

Separate negotiable commercial rights from mandatory data access

The EU Data Act is relevant when a data holder must make certain data available under a legal obligation. The European Commission explains that applicable business-to-business sharing conditions should be fair, reasonable and non-discriminatory, with specific rules governing compensation. This is not a blanket permission to charge any reseller an unrestricted premium, and a voluntary marketplace contract is not automatically the same as mandatory sharing. A pricing model should first label the transaction: statutory access, voluntary licensed product, or a service that combines both. Only then should the analyst examine legitimate cost recovery, operational burden and incremental commercial value. Product managers should seek jurisdiction-specific legal review for real contracts, especially when personal data, trade secrets or competition restrictions arise. This article is a model design, not a representation that all datasets fall under the same legal regime.

Build a rights-by-use matrix instead of one premium tier

A practical matrix uses rows for uses and columns for buyer roles. Internal business intelligence might allow querying and reporting inside one legal entity; model development might permit creation of derived statistical features without exposing source records; external redistribution might permit publication only of aggregated outputs above a minimum disclosure threshold. Time, geography and recipient count can further refine each right. W3C ODRL offers a machine-readable policy model, but its vocabulary alone does not enforce permission. Enforcement needs access policies, contract terms, auditing and verification. Store each grant as a versioned entitlement attached to an identifiable dataset. When a buyer upgrades, append a new entitlement rather than overwriting the original license history. This is valuable when a disputed use was lawful under the older terms but not under a recently renegotiated contract.

Price a transparent hypothetical scenario

Consider a fictional dataset with an annual base delivery cost of $24,000, expected support cost of $6,000 and a target contribution margin of 40 percent. If the seller expects ten equal internal-use buyers, the illustrative break-even-plus-margin price per buyer is ($24,000 + $6,000) / (10 × 0.60), or $5,000. That is a deliberately simple allocation, not evidence of market willingness to pay. A redistribution right could be modeled as an incremental value component, but do not simply double the price. Ask what incremental opportunity the buyer gains, what substitution risk the seller bears, how redistribution affects other customers and what additional monitoring costs exist. Run a sensitivity grid with five, ten and twenty buyers plus low and high reuse assumptions. A transparent model makes the premium negotiable and exposes its uncertainty.

Include enforcement and withdrawal reserves

Additional rights create more operational obligations. A buyer distributing derived outputs may need extra audit support, license-identifier propagation and an agreed response if a source provider withdraws permission. Model the reserve for investigation, correction and notices explicitly rather than burying it in gross margin. For instance, a hypothetical three percent reserve may be appropriate for a pilot sensitivity test, but the actual percentage should come from observed disputes and contract exposure. Track the exact lineage of released products and determine whether a downstream aggregate is reversible or can reveal individual records. Data protection requirements are separate from rights expression; ODRL does not turn an unlawful processing purpose into a lawful one. The seller should offer a clear operational description of how rights are reviewed, revoked, or renewed when a dataset or contract changes.

Test whether the contract survives a realistic use case

Ask five questions before declaring a data product ready for sale. Can a buyer identify each permitted action without consulting the sales team? Can software map the license version to the API key and billing identity? Can both parties distinguish raw redistribution from a permitted derived result? Is the price calculation reproducible from declared costs and expected users? And does an auditor know which rights applied when an output was produced? A pilot can use three hypothetical buyer personas and document how each receives a different entitlement with the same underlying dataset. Record mistaken permissions, support tickets and contract renegotiations as quality signals. Finndy Research should separate this rights-pricing problem from infrastructure architecture and AI social product design, making data commercialization an independently testable discipline.
